Chief Justice Roberts, who is expected to join the liberal members of the court in the subsequent judgment, attempted to barter with the conservative judges during their deliberations on the case. According to reports, Roberts is prepared to uphold a Mississippi statute prohibiting abortions beyond 15 weeks of a woman’s pregnancy.
Given the likelihood that a 5-3 majority in Dobbs will overturn Roe based on Justice Samuel Alito’s draft majority opinion, in that case, Chief Justice John Roberts has allegedly advocated that Roe should be retained, but Casey should be dismissed as a compromise.
According to CNN, it seems as though five justices will vote to overturn Roe v. Wade. According to sources, Chief Justice John Roberts did not want to overturn Roe v. Wade in its entirety, which means he would have dissented from some of Alito’s draft judgment, presumably along with the court’s three liberal justices.
That would mean that Alito would be joined by Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett. They would form the conservative majority that would overturn Roe v. Wade.
Roberts is willing, however, to uphold the Mississippi law that would ban abortion at 15 weeks of pregnancy. Under current law, the government cannot interfere with a women’s choice to terminate a pregnancy before about 23 weeks, when a fetus could live outside the womb.
Justice Samuel Alito’s draft opinion in Dobbs v. Jackson Women’s Health Organization was authentic, Roberts affirmed on Tuesday. However, the draft was written in February and did not represent the court’s current or final view.
In the draft, Alito overturned Roe v. Wade, which overturned state abortion rights across the country and permitted states to enact individual abortion laws.
On Thursday, Chief Justice John Roberts termed the leak of the draft court judgment overturning Roe v. Wade “absolutely appalling.”
The disclosure came after a copy of the ruling was leaked to the press. Further, the justice dismissed any suggestion that the leak would impact the Supreme Court’s ultimate judgment.
