Court documents revealed by Fox News on August 17 revealed that Hollywood superstar Hally Berry was seeking sole custody of her child with French actor Olivier Martinez, following their divorce. The documents showed that the famous actress was taking the step because of numerous actions taken by Martinez over the last few months. These included unilateral decision-making, interfering with their son’s “best interests,” and continuously violating the court orders imposed against the actor.
In the filing, Berry explained that while she knows she’s not perfect and has committed several mistakes during their relationship and in her life, she believes that the legal actions she’s taking are in the best interest of their son Maceo. The document also said that one of the latest situations that severely affected the relationship between the two Hollywood stars was Martinez’s “detrimental” and “turbulent” intervention for the therapeutic and educational needs of the 10-year-old boy.
Berry claimed that her ex-husband has been interfering with psychiatric and educational assessments for their son. The actress said such interference included failing to stick to the custodial time agreements, dismissing therapy and co-parenting therapy for Maceo, using football as leverage in their negotiations, and tutoring after their son fell behind in his academic institution.
The filing detailed that one of the worst acts committed by the French actor was to angrily discuss with Berry their custody battle in front of the child, which was an act that their divorce settlement forbade. The document added that Martinez’s actions and poor cooperation with the 10-year-old boy have been severely detrimental to his welfare and health, and have been one of the main reasons behind his problems at school.
The former couple officialized their divorce in 2023, following a court battle that lasted eight years and cost the actress nearly $10,000 per month for child support. Court documents of that time revealed that the Oscar-winning actress was set to pay the French actor 4 percent of any income she made that exceeded $2 million. She was also the main responsible for Maceo’s health care, private school tuition, and 100 percent of the 10-year-old boy’s extracurricular activities.
According to their divorce judgment, the French actor is obliged not only to take reasonable actions in contributing to his son and finding employment if there’s a period where he doesn’t have any. The judgment also determined that the two Hollywood actors could not talk badly about them in front of their son.
The filing said that Maceo has been psychologically and emotionally affected by some attitudes of his father, which included aggressive and “combative behavior” against Berry, which he has shown in front of his son. The document added that Martinez’s attitude became even worse when he was alone with Maceo, although he was never physically violent against him.
